golf - GREEN FEES  

1. Purpose and identification of the seller

These General Terms and Conditions of Sale (GTC) govern the online sale of green fees (access fees to the golf course) offered by Le Domaine de Saint-Endréol Golf & Spa Resort, operated by Société d’Exploitation et de Gestion de Saint-Endréol (SEGSE), a limited liability company (SARL) with a share capital of €4,157,190, whose registered office is situated at 4300 Route de Bagnols en Forêt, 83920 La Motte, registered with the Draguignan Trade and Companies Register under number 382 867 364, SIRET 41398893200013, intra-Community VAT number: FR51 413 988 932. 2. Acceptance of the Terms and Conditions

Any booking or purchase of a green fee via the website implies the customer’s unconditional acceptance of these Terms and Conditions.

3. Description of services

Green fees entitle you to access the golf course (9-hole, 18-hole or other packages) on the date and at the time booked. The services offered may be subject to change depending on:

• weather conditions
• course maintenance
• exceptional circumstances

The Domaine de Saint-Endréol Golf & Spa Resort reserves the right to adjust access to the course for operational or safety reasons.

4. Booking and payment

Bookings must be made exclusively online via the official website. Payment is due immediately at the time of booking and must be made by credit card via a secure payment system or by any other method offered on the website. The booking is considered firm and final once payment has been confirmed. In accordance with Article L221-13 of the French Consumer Code, a confirmation email summarising the service booked, the date, time, price and these Terms and Conditions is sent to the customer once their order has been confirmed.

5. Prices

Prices are quoted in euros, inclusive of all taxes. The Domaine de Saint-Endréol Golf & Spa Resort reserves the right to change its rates at any time. The applicable rate is the one in force at the time the booking is confirmed.

6. No right of withdrawal 

In accordance with Article L221-28 of the Consumer Code, leisure services provided on a specific date or during a specific period are not subject to the right of withdrawal. Green fees purchased are therefore neither refundable nor exchangeable, except as provided for in Article 7.

7. Changes – Cancellations – No-shows

Any request for a change or cancellation must be made at least [12 hours] before the departure time.
Terms and conditions:

• Cancellation is free of charge up to 1 hour before departure
• After this time, no refund will be given
• In the event of a no-show, the full amount remains payable

In the event of weather conditions rendering the route impassable or an exceptional closure decided by the operator, the customer will be offered a postponement of the booking, a credit note or a full refund, at their discretion. In accordance with Article 1218 of the Civil Code, where the impediment is permanent, the contract is automatically terminated and any sums paid are refunded.

8. Terms of access and house rules

Access to the course is subject to compliance with:

• golf etiquette
• the club’s rules and regulations
• the current dress code

Players must possess the required level of skill and suitable equipment. The Domaine de Saint-Endréol Golf & Spa Resort reserves the right to refuse access to the course to anyone who does not comply with these conditions, without refund.

9. Liability

Le Domaine de Saint-Endréol Golf & Spa Resort shall not be held liable in the event of:

an accident resulting from inappropriate behaviour or failure to comply with the rules loss, theft or damage to personal belongings
interruption or alteration of the service due to force majeure or external circumstances (weather, administrative decision, etc.)
The above limitations of liability do not apply to personal injury, which cannot be subject to any limitation or exclusion of liability in accordance with the provisions of Article R212-1 of the French Consumer Code.

10. Personal data (GDPR)

All personal data collected by Le Domaine de Saint Endréol Golf & Spa Resort, by whatever means, is for the exclusive use of the Establishment.

In accordance with Article 34 of the amended French Data Protection Act 78-17 of 6 January 1978 and the General Data Protection Regulation (EU Regulation 2016/679) or ‘GDPR’, the Customer has the right to access, amend, rectify and delete data concerning them.

11. Mediation and dispute resolution

In accordance with Articles L611-1 et seq. of the French Consumer Code, the customer may, free of charge, refer the matter to a consumer ombudsman with a view to reaching an amicable resolution of the dispute. The designated mediator is: La Médiation Tourisme et Voyage, https://www.mtv.travel/. The customer may also submit a complaint via the European Online Dispute Resolution (ODR) platform, accessible at the following address: https://ec.europa.eu/consumers/odr.

12. Applicable law and competent court

These Terms and Conditions are governed by French law. In the event of a dispute, and following an attempt at amicable resolution, consumer customers may bring the matter before the competent court of their choice in accordance with the rules of ordinary law (Article R631-3 of the French Consumer Code). For business customers, exclusive jurisdiction is attributed to the courts within the jurisdiction of the operator’s registered office.

TOURIST RESIDENCE - ROOM ACCOMMODATION

Rooms:

• The room is available at 15h and must be left at 11h.
• Rooms are cleaned between 9h and 15h except kitchen area

City tax:

3,46 € /pers /day (except for children under 18)

Deposit:

• For 1 or 2 nights: deposit of 50 % of the total amount of your stay.
• For 3 nights and more: 30 % of the total amount of your stay.
• “Best available rate” requires a full payment, not refundable and not modifiable.

Cancellation fees:

If our establishment were to be forced to close following new sanitary measures, we will refund the total amount of your deposit paid.

1/ Public rates and package

Out of high season, weekends and bank holiday:

• For a cancellation prior to 48 hours on the day of arrival the deposit is refund
• For a cancellation less than 48 hours on the day of arrival we will retain 100 % of your deposit

During high season, weekends and bank holiday:

• For a stay of 5 nights and more, if cancelling booking happens more than 7 days prior the arrival, we will retain 30 € of administration charge from your deposit.
• For a stay of less than 5 nights, if cancelling booking happens more than 48 hours prior the arrival, we will retain 30 € of administration charge from your deposit.
• For a stay of 5 nights and more, if cancelling booking happens less than 7 days prior the arrival, we will retain 100 % of your deposit.
• For a stay of less than 5 nights, if cancelling booking happens less than 48 hours prior the arrival, we will retain 100 % of your deposit.

2/ “best available rate”

Client accept to pay the full payment at the booking, this rate is not refundable and not modifiable after the booking.

And in any case if no show on the day of arrival, the total balance of the stay will be charged by the booking service.
